Location: Richmond Virginia

The Legal Department’s Enterprise Loss Mitigation Advice Team is seeking an attorney to provide legal and regulatory support for the Enterprise Loss Mitigation collection agency oversight function. The position will require extensive involvement in supporting assessment of nationwide collection agency portfolio, including review of external and internal vendor materials (letters, call scripting, etc.), as well as assessment of vendor practices for compliance with consumer regulatory laws and internal loss mitigation policies and controls.

Job Responsibilities will include:

  • Collaborate wit! h the business and others within Legal to provide legal and re! gulatory risk guidance concerning agency and vendor practices
  • Review and evaluate collection agency practices to identify key areas of risk or areas and assessment prioritization
  • Act as primary counsel for on-site agency assessments to assist with the identification of risks associated with agency practices, compliance structure, and overall governance
  • Review agency communications, including letters, phone scripts, etc. for legal risk
  • Evaluate relative risks of agency practices and controls and advise on findings/best practices
  • Provide guidance and feedback on sufficiency of compliance assessment program as legal and regulatory risks are identified and evolve
  • Collaborate with other enterprise teams involved in third party management
  • Work with Enterprise Loss Mitigation, Operations, IT, Third Party Management, and Compliance stakeholders to address risks and resolve issues.

  • Provide legal guidance to the business to assist the business in understanding the overall risk profile of individual agencies
  • Advise on relative risks of agency practices to assist the business in prioritizing efforts
  • Identify risks that need to be addressed or refined/updated via written guidance to agencies
  • Coordinate within Legal on the development of agency standards and ensure consistency of third party vendor standards across the enterprise
  • Assist collections with development and updating of state and federal legal requirements database for US Card Loss Mitigation, its vendors, agencies and law firms.
  • Support agency complaint policy and standards consistent with enterprise consumer complaints policy
  • Review agency complaints to ensure proper responses
  • Track complaints drivers to determi! ne trends and needs for additional controls
Qualifications
Basic Qualifications:
  • A JD and admission to at least one state bar or military experience
  • 3 years of consumer financial services litigation, compliance, third party management or audit experience, or 3 years of counsel experience with state and federal collections laws and regulations and/or regulatory experience involving consumer financial services
Preferred Qualifications:
  • 5+ years of consumer financial services legal, regulatory or compliance guidance experience in a major law firm or Fortune 500 company in-house legal or compliance department
  • Knowledge of, and proficiency with, providing advice regarding FDCPA, state debt collection laws, TCPA and FCRA
  • Counsel or compliance experience with consumer finance laws, collections laws and supporting regulations and disclosures
  • Ability to work autonomously
  • Third party management and/or vendor assessment experience
  • ! Experience providing advice on state and federal collection laws for a financial services company
Knowledge of, and proficiency with, providing advice regarding laws and regulations related to unfair or deceptive acts and practices
  • Ability to provide advice and oversight for third party vendors
  • Experience litigating collection or consumer finance matters
  • Ability to work effectively both in teams and independently; to make effective, integrated decisions; and to collaborate effectively with associates at all levels in the company
  • Ability to prioritize a significant volume of projects and requests with multiple, simultaneous deadlines
  • Excellent written and oral communication skills with the ability to influence others
  • Ability to deal with ambiguous situations, complex concepts and details
  • Analytical and problem solving skills
  • Ability to identify risks and issues proactively, and drive creat! ive solutions
