Under administrative direction of the City Attorney, performs a wide range of difficult and/or highly complex professional legal work in the service of all City departments, City! Council, and various commissions and boards; performs related duties as required and assists the City Attorney in office administration matters as assigned. Senior Deputy City Attorneys lead the office of the City Attorney in the absence of the City Attorney. May provide supervision to administrative and lower level attorney staff.

Examples of Duties:

  • Performs legal research and prepares opinions on various legal problems for City Council, Boards and Commissions, and City Departments.
  • Studies, interprets and applies laws, court decisions, ordinances, and other legal sources in advising officers and employees of the City in legal matters.
  • Prepares and drafts ordinances, resolutions, administrative policies, contracts, deeds, leases, and other legal documents and instruments; reviews such documents and offers opinions as to legal acceptability when presented to the City for consideration.
  • Represents the City and its off! icers and employees in litigation including motions, trial of ! cases and appeals in civil actions brought by or against the City in state and federal court.
  • Prepares and tries cases before administrative agencies.
  • Advises on legal aspects associated with various statutorily described activities, such as eminent domain.
  • Negotiates contracts, real estate purchases, and leasing transactions.
  • Analyzes complex financial issues and render opinions.
  • Advises on liability and insurance issues and claims.
  • Investigates claims and complaints by and against the City.
  • Assists City Attorney in making decisions with regard to when to prosecute, compromise or dismiss civil litigation.
  • Answers inquiries from City departments and other agencies pertaining to City operations.
  • Attends meetings of the City Council and Boards and Commissions as a legal advisor.
  • Responds to citizen complaints and requests for information.
  • Represents the City in the community and! at professional meetings as required.
  • Works with the City Attorney in planning, organizing, and coordinating the work of other staff members assigned to the office.
  • Adheres to customer service philosophy and demonstrates skill in establishing a strong and positive image of department and City.
  • Trains other staff in recent developments in the law.
  • Assists in the development and implementation of department goals, policies, procedures, and budget development; serves as administrative and technical assistant to the City Attorney.
  • Responds to questions and inquiries from the press
  • Provides functional and technical supervision of support staff and, as assigned, attorney staff
  • Acts as liaison with the Constitutional Officers on matters of joint interest and with outside counsel on civil matters.
  • Represents the Office of the City Attorney on various committees.
  • Gives legal advice and counsel on matte! rs such as acceptable methods for gathering evidence; prepares opinions! concerning the actions, powers, duties, functions, and obligations of City officials.
  • Oversees services provided by outside legal specialists engaged by the City for special legal problems.
  • Provides guidance to assistant and deputy city attorneys, paralegal, and clerical staff.
  • Performs related duties as required.
Typical Qualifications:
Requires a Juris Doctorate from an accredited law school. Requires extensive experience, a minimum of a eight (8) to ten (10) years of experience in government/municipal legal practice, or equivalent private practice experience. Must be an active member in good standing in the Virginia State Bar.

Requires thorough knowledge of: legal office work, procedures, terminology, and documents, including proper English grammar, spelling, and punctuation; legal principles and practice, including civil, criminal, constitutional, and administrative law and procedures; judicial procedures! and rules of evidence; established precedent and sources of legal reference applicable to municipal activities; ordinances, statutes, and court decisions related to municipal entities; the organization and operating procedures of a City Attorney's Office.

Requires the ability to: establish and maintain effective working relationships with others and work as a member of a team; plan and organize own work and work space; prepare and proofread documents; read, explain, and interpret forms, rules, and policies; utilize various specialized software applications; communicate clearly and concisely, both orally and in writing; organize, interpret, and apply legal principles and knowledge to complex legal problems; conduct research using state of the art methods of legal research to prepare sound legal opinions; present statements of law, fact, and argument clearly and logically; interpret and make decisions in accordance with laws, regulations, and policies; analyz! e and prepare a variety of legal documents; perform increasingly comple! x legal work using independent judgment; follow instructions, policies, and procedures; communicate effectively in person, on telephone, and in writing; work independently, recognize priorities, and meet deadlines.

Applicants must possess and maintain a valid motor vehicle operator's license issued by the State of Virginia and must have a satisfactory driver's record based on the City of Hampton criteria. Any person offered employment in the position shall be subject to a criminal history background check. A combination of education and experience which qualifies an applicant may be considered in lieu of the more specific requirements above.

Supplemental Information:
This is the most advanced and most highly responsible level classification in the City Attorney series below City Attorney. Incumbents of this class are expected to use a high degree of independent judgment and exercise considerable discretionary judgment in dealing with serious, co! ntroversial and complex matters in the determination of legal, administrative and management strategies in critical, specialized areas to which assigned. Upon assignment of area(s) of responsibility by the City Attorney, work within the assigned program area is scheduled and carried out upon consultation with the City Manager, department heads or the administrative body involved. This classification is distinguished from the Deputy City Attorney class by the capacity and responsibility of this position to substitute for the City Attorney in office administration and policy input, by the broader discretionary and decision making responsibilities, by the complexity of legal work performed independently, and any assigned responsibility for supervision of other attorney staff.

Requires tact, good judgment and discretion in dealing with other staff, the public and elected/appointed officials; must maintain the confidentiality of all information. Requires continuing lega! l education in subjects affecting municipal law. Requires considerable ! research and analysis, trial preparation and often requires hours beyond the normal workweek; requires some evening meetings. This is an exempt position.
