The Legal Department’s Legal Loss Mitigation Team (Litigation) is seeking a Senior Associate to provide legal, audit process, and project management support for legal issues for designated areas within! Loss Mitigation Recoveries group and to work with attorneys providing legal advice for Capital One’s US Card Loss Mitigation Recoveries group. The position will consist of day-to-day testing, monitoring, and oversight of our third party vendors with the Legal Loss Mitigation personnel who are responsible for managing the Legal External Attorney Network of law firms who bring collection actions on behalf of Capital One. The job responsibilities will include review and testing of vendor policies and materials (customer treatment, letters, pleadings, call scripting, etc.), and assessment of vendor practices for compliance with all consumer regulatory laws and internal loss mitigation policies and controls. The remediation of any test findings will also be part of the job responsibilities for this role. This position will entail numerous interactions with our third party vendors, Legal Department subject matter experts and senior line of business attorneys.
This position! requires the ability to travel 15-25% of the time for on-site! visits.
Job Responsibilities will include:
- Testing and monitoring of third party vendors, both through off-site projects and on-site visits
- Working with third party vendors and other key Loss Mitigation associates and Legal Attorney Managers to remediate any findings identified through testing;
- Providing legal support for complex projects and legal advice requests;
- Providing legal support to Legal Loss Mitigation Team
- Providing reporting and management assistance to the attorneys and business partners; and
- Providing project management and oversight support regarding any Loss Mitigation document collection, document reviews, factual and legal research projects under the direction of the managing attorney Loss Mitigation related work.
Basic Qualifications:
- Bachelor’s degree or military experience
- At least 2 years of experience as a Paral! egal or legal support associate, preferably in the litigation field
- Experience testing or auditing performance and/or compliance
- Experience interacting with external vendors
- Strong prioritization skills
- Strong problem solving and decision-making skills
- Excellent communication and influencing skills, both written and verbal
- Ability to build collegial and effective relationships with business clients, attorneys, project managers, and corporate compliance professionals
- Knowledge of consumer finance laws, collections laws and supporting regulations and disclosures
