    Responsibilities

    • This is an advanced developmental position description (PD) leading to the full performance PD Attorney-Adviser (GEN) PD# 9E6660. The duties at this level are characteristic of the full performance PD.
    • As an Attorney-Adviser in the Office of Appellate Operations, provides technical assistance without prior guidance or instruction to the Appeals Council (AC) in the review of decisions and dismissals rendered by Administrative Law Judges (ALJs).
    • Analyzes, researches and formulates comprehensive recommended actions/decisions, and acts on requests for review of hearing decisions and dismissal orders issued by ALJs in claims filed under Titles II and XVI of the Social Security Act, as amended.
    • The incumbent is responsible for reviewing: new court cases; requests for voluntary remand initiated by the Office of the General Counsel (OGC); and cases remanded by the Courts.
    • Provides assistance to the Appeals Council in all program areas in order to ensure proper disposition of cases coming before that body.
    • Responsible for recognizing and identifying multiple and complex policy and lega l issues and providing a written analysis and recommendations to the Appeals Council with additional oral advice and consultation as necessary.
    • Prepares a written evaluation and recommendation for action to the AC in some cases involving significant policy issues and questions regarding the application of Federal Circuit Court opinions or Acquiescence Rulings in particular cases.

    Qualifications

    Positions will be filled in the Excepted Service through the use of Schedule A 213.3102(d) appointing authority. Competitive examining procedures will not be conducted. Applicants must meet the minimum qualification requirements shown above.

    Applicants must possess a law degree and currently be an active member in good standing of the bar. You must be duly licensed, authorized and eligible to pr actice as an attorney under the laws of a state, District of Columbia or US Territory. This is a continuing requirement of the position.

    In addition to the above, applicants must also meet one of the following requirements:

    For GS-11:
    • A LL.B. or J.D. and at least 1 year of professional legal experience equivalent to the GS-9 grade level or higher in the Federal service.
    • A second professional law degree (LL.M) which requires one full year of graduate study.
    • A J.D. or LL.B. and superior law student work or activities as demonstrated by one of the following:
    (a) Academic standing in the upper-third of the law school graduating class.
    (b) Work or achievement of significance on your law schools' official law review.
    (c) Special high-level honors for academic excellence in law school, such as election to the Order of the Coif.
    (d) Winning of a moot court competition or membership on the moot court team that represents the law school in competition with other law schools
    (e) Full-time or continuous participation in a legal aid program as opposed to one-time, intermittent, or casual participation.
    (f) Two significant summer law office clerk work experiences of at least 40 hours per week.

    Applicant must be duly licensed, authorized and eligible to practice as an attorney under the laws of a state, the District of Columbia, the Commonwealth of Puerto Rico, or a U.S. Territory.

    To be considered, applicants must provide proof that they are authorized to practice law. Such proof can include a current active bar card, a screen print from a state bar web site that reflects you are an active member of the bar or a letter/certificate from the bar certifying that you are licensed and authorized to practice law. Being an active member of the state bar association is not the same as being an active member in good standing of th e state bar.
