    The Executive Office for Immigration Review (EOIR) seeks highly-qualified individuals to join our team of expert professionals in becoming a part of our challenging and rewarding Agency. The primary mission of EOIR is to adjudicate immigration cases by fairly, expeditiously, and uniformly interpreting and administering the Nation's immigration laws. Under delegated authority from the Attorney General, EOIR conducts immigration court proceedings, appellate reviews, and administrative hearings. EOIR consists of three adjudicatory components: The Office of the Chief Immigration Judge, which is responsible for managing the Immigration Courts where Immigration Judges adjudicate individual cases; the Board of Immigration Appeals, which primarily conducts appellate reviews of these Immigration Judge decisions; and the Office of the Chief Administrative Hearing Officer, which adjudicates immigration-related employment cases.

    The Paralegal Specialist (Emergency Stay Unit) position is located in Falls Church, VA, at the Board of Immigration Appeals (BIA). The BIA's primary mission is to produce authoritative administrative case law in the form of formal BIA decisions, interpreting the immigration laws and laying down guidelines for the exercise of the Attorney General's delegated administrative discretion. In addition BIA has appellate jurisdiction over essentially all decisions of Immigration Judges arising in deportation, exclusion, rescission, and bond proceedings.

    This is a Competitive Service position; additional positions may be filled from this announcement within 90 days of certificate issuance.

    Responsibilities

    Duties include but are not limited to the following:

    • Applies legal research, analytical and communication skills to support Board Members in performing their case adjudication responsibilities, including th e adjudication of emergency stay requests.
    • Supports stakeholders (i.e. Board Members) and staff attorneys in performing their case adjudication responsibilities, specifically the adjudication of stay requests.
    • Responds verbally and in writing to inquiries from interested parties outside of the Board about the Emergency Stay of Removal Process.
    • Reviews requests for stays of removals, and provides summaries and indicates to attorneys assigned to particular cases.
    • Analyzes records of proceedings to understand the legal issues presented.
    • Researches assignments requested by attorneys.
    • Performing legal research into laws, legislative history, precedent-setting cases, decisions and opinions that may be applicable.
    • Provides written analysis and/or legal memoranda regarding the results of research.
    • Screens cases to identify legal issues and enters them into EOIR's database.
    • Drafts and prepares board orde rs and decisions in straightforward cases to be signed by upper management and/or Board Members.

    In order to qualify for the Paralegal Specialist (Emergency Stay Unit) position, you must meet the following minimum qualifications:

    To qualify at the GS-9 level, applicants must have at least one year of specialized experience equivalent to the GS-07 level in the Federal Government that equipped them with the particular knowledge, skills, and abilities to perform successfully the duties of this position that included: 1) utilizing automated legal databases to verify legal citations and statutory references; 2) analyzing and organizing factual, legal and archival records; 3) drafting legal documents in straightforward cases; and 4) providing assistance to attorneys for hearing and/or drafting appellate orders.

    OR
    Have a Masters or equivalent graduate degree or 2 full years of progressively higher level graduate education leading to such a degree. (Must submit transcripts.)
    OR
    Possess a combination of the above described graduate education and specialized experience such that they total 100% of the stated minimum qualifications for the GS-09 level. Only graduate education beyond the first year (18 semester hours) may be used when combining education and experience for this option. (Must submit transcripts.)

    To qualify at the GS-11 level , must have at least one year of specialized experience equivalent to the GS-09 level in the Federal Government that equipped them with the particular knowledge, skills, and abilities to perform successfully the duties of this position that included: 1) conducting extensive research of various laws, court and/or administrative decisions and interpretations; 2) utilizing automat ed legal databases to verify legal citations and statutory references; 3) analyzing and organizing factual, legal and archival records; 4) drafting complex legal documents in straightforward cases; and 5) providing assistance to attorneys for hearing and/or drafting appellate orders.

    Have a Ph.D. or equivalent doctoral degree or 3 full years of progressively higher level graduate education leading to such a degree in finance, business, accounting, or other directly related field. (Must submit transcripts.)
    OR
    Have an appropriate combination of successfully completed graduate education and experience. To determine your combination, first compute your experience as a percentage of the experience listed in A above; then determine your education as a percentage of the education listed in B above; then add the two percentages. The total percentages must equal at least 100 percent. Only graduate education in excess of two full years (36 hours) may be used to qualify. (Must submit transcripts.)
